Chooksy Terms of Use and End User Licence Agreement

Scope: This agreement applies to the Chooksy mobile game and its related services. Other Solnova Labs apps have their own terms.
1. Agreement and who can play
This agreement is between you and Solnova Labs Pty Ltd ("Solnova", "we", "us"), not Apple or Google. By downloading, installing or using Chooksy (the "Game") you agree to it.
Chooksy is designed for players of all ages. If you are under 18, a parent or guardian must agree to these terms on your behalf. Parents and guardians are responsible for a child's use of the Game and for any purchases made on their device.
2. Licence
We grant you a revocable, non-exclusive, non-transferable licence to install and use the Game on devices you own or control, for personal, non-commercial enjoyment, subject to these terms and the rules of your app store.
3. Game content and virtual items
Virtual items: Coins, gems, chooks, eggs, equipment, treats and other items in the Game are virtual items licensed to you for use in the Game. They have no real-world value, cannot be sold, transferred or exchanged for money, and are not property you own.
Changes: We may balance, change, add or remove Game features, items, levels and events.
Progress: Your progress is stored on your device. If you delete the Game or lose or replace your device, your progress may be lost.
Chance: Some items may be obtained by chance.
Fiction: Chooksy is entertainment. Chooks, breeds and care activities in the Game are fictional and are not advice on keeping real animals.
4. Ads and purchases
Chooksy may offer optional rewarded ads. You never need to watch an ad to play. If we add optional purchases in future, they will be processed by Apple or Google under their terms, and refunds are handled through Apple or Google.
5. Ownership of the Game
All rights in the Game, including its software, artwork, animation, sound, music, text, game design, chooks, characters and names (including "Chooksy"), belong to Solnova or our licensors. Some assets are used under licence from third parties. No ownership is transferred to you.
6. Rules of use
You must not:
If you break these rules we may restrict or end your access to the Game.
7. Updates and availability
We may update the Game, and some features (such as events and new content) may need an internet connection. We do not guarantee that any event, level or feature will always be available. We may change or stop offering the Game, and we will give reasonable notice where practical.
8. Apple and Google
These terms apply in addition to the terms of the app store you used. Apple and Google are not responsible for the Game, its content, support, maintenance or any claims about it. If you downloaded the Game from the Apple App Store: this agreement is between you and Solnova only; Apple has no obligation to provide maintenance or support; if the Game fails to meet any applicable warranty you may tell Apple, who may refund any purchase price, and Apple has no other warranty obligation; Solnova, not Apple, is responsible for any claims about the Game or your possession and use of it; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, or for loss of progress or virtual items caused by deleting the Game, losing a device or a technical fault.
10. Governing law
This agreement is governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction, without limiting any rights you have under the law of the place where you live.

Chooksy Privacy Policy

1. The short version
Chooksy is designed for players of all ages, including children. You can play without creating an account and without giving us your name, email address or any other personal information. Your game progress is stored on your own device. If you choose to watch an optional ad for a reward, the ad is set up for children and is not personalised.
2. Information we collect
What we do not collect: We do not ask for or collect names, email addresses, birth dates, phone numbers, photos, contacts, precise location or any messages. Chooksy has no chat, no public profiles and no user-generated content.
Game progress: Your chooks, coins, gems, level progress and settings are stored on your device, not on our servers. If you delete the game, that data is deleted from the device. Backups made by your device (for example iCloud or Google backup) may include game data and are managed by Apple or Google, not by us.
Update checks: The game may contact our servers to check for updates such as event dates and new content. Like any internet request, this includes your IP address and basic technical details such as the app version. We use it only to deliver the update and keep the service running, and we do not use it to identify you. These logs are kept by our web host for a limited time.
App store reports: Apple and Google give us summary reports such as downloads, ratings and crashes. These do not tell us who you are.
3. Advertising
Optional rewarded ads only: Chooksy shows an ad only when you choose to watch one in return for a reward, such as keeping a run going, doubling coins or refilling energy. You never need to watch an ad to play, and there are no forced ads.
Set up for children: Ads are provided by a third-party advertising network, which we will name here before any ads are switched on, and are configured for child-directed use. There is no personalised or behavioural advertising, and we do not give the ad network any personal information, because we do not collect any. The ad network may collect limited technical information (such as IP address, device type and whether an ad was shown) to deliver and measure the ad and to prevent fraud, as described in its privacy policy, which we will link here.
Links: Anything that opens outside the game, such as a link or an ad, is protected by an "ask a grown-up" check.
4. Children
Chooksy is intended for players of all ages, including children under 13. We designed it so that a child can play without giving us any personal information. We do not knowingly collect personal information from children.
Parents and guardians: if you believe your child has given us personal information, or you have a question about your child's use of Chooksy, contact us using the details below and we will help. We design Chooksy to meet the privacy requirements that apply to children's apps, including the requirements of the Apple App Store and Google Play.
5. How we use and share information
Purpose: We use the limited information described above to run the game, deliver updates, fix problems, keep the game fair and respond to support enquiries.
No sale or profiling: We do not sell or rent personal information, and we do not use information about players for advertising profiles.
Service providers: We share information only with providers needed to run the game: Apple and Google (distribution), a third-party advertising network (optional ads) and our hosting provider for update checks. We may disclose information if the law requires it.
6. Where information is handled
Update-check requests are handled by our web hosting provider, whose servers may be located outside Australia, including in the United States. App stores and the ad network may process information in other countries, including the United States and Singapore. By using Chooksy you understand that some technical information may be handled overseas.
7. Your rights and choices
Access, correction and deletion: Because Chooksy does not collect personal information about you, we generally hold nothing to access or delete. To remove your game data from your device, delete the game. You can contact us at any time about any privacy question.
Complaints: Please contact us first and we will try to resolve it. You can also complain to the Office of the Australian Information Commissioner at www.oaic.gov.au (https://www.oaic.gov.au).
8. Changes to this policy
We will update this page and its date if this policy changes. If we add features that change how information is collected (such as optional sign-in or in-app purchases), we will update this policy before those features are released and tell players in the game.

- copy, extract, republish, sell or distribute the Game's artwork, sound, music, text or data;
- use the Game's content to train, test or improve any artificial intelligence or machine learning system;
- use the Game for any unlawful purpose.
If you break these rules we may restrict or end your access to the Game.
7. Updates and availability
